From receipt of instructions through to final remittance, our turnaround times are impressive. In the vast majority of cases, all costs are recovered from the defaulting lessee and we also fund court fees on your behalf pending recovery.
Whilst the most common breaches relate to the non-payment of rent, service charges or other sums due, there are other possible breaches of a lease.
We manage cases efficiently to ensure the landlord’s position is protected. In many instances, we are able to obtain damages and compensation on their behalf.
If a leaseholder is in breach of the terms of their lease, we can pursue forfeiture action on your behalf for both criteria debt and non-debt breaches on either residential or commercial premises.
Given the extra protection afforded to residential leaseholders under the law, it is essential that legal advice takes account of the additional requirements in any residential forfeiture proceedings.
Only a small proportion of cases become fully defended or are highly technical but, where this occurs, we deliver expert advice and representation at Court, the First Tier Tribunal or Upper Tribunal.

The upper residential floors of the subject property formed the demise under a head lease between freeholder and head landlord, and subsequently a residential lease to the tenant from the head landlord. The head landlord was obliged under the head lease to contribute to the freeholder’s sinking fund, and in turn recharged this and other sums owed to the freeholder, in addition to its own service charge, by way of a ‘Landlord Estate Charge’ to the residential tenant under the underlease. The tenant initially paid this sum without objection as it was relatively minor. However, the sum rose from 2011 and the tenant argued that it was not obliged to pay into a sinking fund.
A claim should be discontinued by service of a Notice of Discontinuance under CPR 38; a request by the tenant to dismiss the application could not be considered as a discontinuance of the claim.
