J B Leitch has recently represented a Management Company in the Upper Tribunal, under an appeal against a First-tier Tribunal decision to award costs against one party as a result of that party using unreasonable behaviour in bringing, defending or conducting proceedings before it.  The decision sets a useful precedent and test when setting down judgment on Rule 13 and the suitability of any costs award.
