The decision regarding Vinnie, the dog at the centre of this case, has generated considerable media interest. Having acquired an occupational underlease, the leaseholders moved Vinnie into the property and subsequently the management company attempted to enforce its ‘no pets’ policy. The case considered the reasonableness of this decision.
The High Court considered whether the tenant’s granting of an underlease of part was in breach of the alienation covenant contained its lease.
Consideration was given to the construction of the covenant, commercial common sense and establishing what would have been the intention of the parties at the time the lease was drafted.
