With the BSA now being in force, landlords and building owners may need to consider alternative funding sources and the extent of third party liability prior to seeking payment from leaseholders in certain circumstances. This will potentially include any possible claims against those involved in the construction of buildings who may be in breach of warranties, contracts or guarantees and consideration to providers of any new build warranty policies.
Similarly, building owners will also need to ensure insurance policies provide sufficient indemnity cover and that agreements address issues such as historic liabilities or the kinds of defect which the developer must agree to remedy and the policy of insurance as part of a new build warranties.
